The Family Educational Rights and Privacy Act (FERPA - also known as the Buckley Amendment) is legislation that was originally passed in 1974 and is federal law designed...
"...to protect the privacy of student's education records,
...to establish the right of students to inspect and review their education records,
...and to provide guidelines for the correction of inaccurate or misleading data through informal and formal hearings." (Definition established by AACRAO, 1980)
Although the primary burden in regard to FERPA falls with the official Records Office at any given college (which at CNM is the Enrollment Services Office), every employee of the college would be considered under FERPA to be a "school official" and therefore is also responsible for complying with FERPA regulations.
As a faculty member, your primary responsibility as it relates to this legislation is to understand that the official records you keep regarding a student (including grade books, papers/assignments that have been submitted by students, and any other record that you maintain that is directly related to the student) would be considered education records and are protected by FERPA. This means that you cannot share this information with others including the student's parents, spouse, classmates or even legal authorities. There are certain (very few) exceptions to this, but we do not expect you as a faculty member to have to track on these exceptions.
