Healthcare Criminal History Disqualification



Individuals having certain felony convictions, unmitigated charges or arrests may be disqualified from practicing as a healthcare caregiver in the State of New Mexico under the caregivers criminal history screening act, Sections 29-17-2 to 29-17-5, NMSA 1978.  The following felony convictions will disqualify a student from being enrolled in a HWPS healthcare program.
  • homicide;
  • trafficking, or trafficking in controlled substances;
  • kidnapping, false imprisonment, aggravated assault or aggravated battery;
  • rape, criminal sexual penetration, criminal sexual conduct, incest, indecent exposure, or other related felony sexual offenses;
  • exposure, or other related felony sexual offenses;
  • crimes involving adult abuse, neglect or financial exploitation;
  • crimes involving robbery, larceny, extortion, burglary, fraud, forgery, embezzlement, credit card fraud, or receiving stolen property; or
  • an attempt, solicitation, or conspiracy involving any of the felonies in this subsection.
