Collective Bargaining Agreement for Maintenance and Operations

Part-time employees in the bargaining unit accrue annual leave on a pro-rata basis in accordance with the CNM Employee Handbook.

12.1

Regular full-time employees in the bargaining unit will accrue annual leave as follows:

12.2

Annual leave is accrued each pay period and cannot be used in advance of accrual. The maximum annual leave accrual shall not exceed 30 days or 240 hours.

12.3

Scheduled annual leave (vacation). The Employer will allow annual leave scheduling in accordance with procedures established by the Department Head. When two (2) or more employees in the same job classification apply for the same annual leave slots, seniority will be the determining factor in granting the leave; however, all employees applying for annual leave will be allowed one leave slot prior to a more senior employee being able to exercise his/her seniority for a second leave slot. Management reserves the right to cancel leave based upon the operational needs of the Employer as determined by management. Employees will be given reasonable notice of such cancellation.

12.4

Unscheduled annual leave. The Employer will allow some unscheduled annual leave based upon operational needs as determined by management. Such requests, when allowed, shall be granted on a first come, first serve basis. Only in a case where two (2) or more requests are received from employees in the same job classification at the exact date and time will seniority be a factor. Management reserves the right to cancel leave at any time based upon the operational needs of the Employer as determined by management. Employees will be given reasonable notice of such cancellation.

12.5

All annual leave usage should be requested in advance. All requests are subject to the approval of management, whose decision shall be final.

12.6

When an employee's vacation is interrupted by hospitalization, which has been verified by a physician, such interrupted vacation leave shall be rescheduled at a time mutually agreeable to the supervisor and the employee. Such period of illness shall be charged to available sick leave.

12.8

Employees who receive approval for annual leave may use such leave in quarter hour (15 minute) increments. However, annual leave cannot be used by an employee to address chronic tardiness.
