Administrative Directive

Introduction

There are two categories of Central New Mexico Community College (CNM) employees:  instructional and non-instructional.  Instructional employees include exempt and non-exempt instructors and instructional support employees working on an academic-year basis.  Instructional support employees include instructional technicians, laboratory technicians and tutors. Non-instructional employees are exempt and non-exempt employees hired to perform duties other than student instruction. 1. Instructional Employees

1.1 Instructors.  Instructors include regular full-time, regular part-time, temporary, substitute and casual employees.

1.1.1 A regular full-time instructor works for a minimum of 30 hours per week.  The duties in these hours consist of class contact hours, office hours, and other duties associated with preparation and grading as outlined in the Full-time Faculty Collective Bargaining Agreement. A copy of this agreement is available through a Human Resources Representative.

1.1.2 Regular Part-Time Instructors. A regular part-time instructor is hired from term to term and teaches a workload as approved by the Dean..

1.1.3 Temporary Instructors. Temporary instructors are hired on a waiver of announcement for a specified period of time not to exceed one (1) year.

1.1.4 Substitute Instructors. Substitute instructors are hired for an indefinite period of time to replace a regular instructor.

1.1.5 Casual Instructors. Casual instructors are hired on an intermittent basis for an indefinite period of time.

2. Instructional Support Employees

2.1 Instructional support employees include instructional technicians, laboratory technicians and tutors. Instructional support employees include regular full-time, regular part-time, temporary and casual employees.

2.1.1 Regular full-time instructional support employees have a work year set in accordance with their Collective Bargaining Agreement.

2.1.2 Regular part-time instructional support employees perform  assigned duties totaling fewer than 1872 hours per academic year.

2.1.3 Temporary instructional support employees are hired for a specified period of time not to exceed one (1) year.

2.1.4 Casual instructional support employees are hired on an intermittent basis for an indefinite period of time not to exceed 750 hours per year.

3. Non-Instructional Employees

3.1 Non-instructional employees are exempt and non-exempt employees hired to perform duties other than student instruction. Non-instructional employees include regular full-time, regular part-time, temporary, casual and student employees.

3.1.1 Regular full-time non-instructional employees have a work week normally consisting of forty (40) hours per week of assigned duties.

3.1.2 Regular part-time non-instructional employees have a work week normally consisting of fewer than forty (40) hours per week of assigned duties.

3.1.3 Temporary non-instructional employees are hired for a period of time not to exceed one (1) year.

3.1.4 Casual non-instructional employees are hired on an intermittent basis for an indefinite period of time not to exceed 173 hours per term.

4. Trial Employees

4.1 All full- and part-time exempt and non-exempt employees are considered "trial employees" for an initial period of their employment in any position with the College.

4.1.1 All full- and part-time exempt employees are trial employees for the longer of their initial 28 months of employment or six months from their first day of employment in any position except as noted in Section 3.04E. in the Employee Handbook.

4.1.2 All full- and part-time non-exempt employees are trial employees for the first six months of their employment.

4.1.2.1 The trial period for non-exempt employees may be extended for an additional period, not to exceed six months, at the discretion of the College.

4.1.3 Time spent as a part-time or full-time instructor is not counted toward any trial period.

5. Contracted Employees

5.1 Senior administrative staff and certain other administrative staff specifically identified by the President of the College are considered "contracted employees."  Contracted employees serve at the discretion of the President and there is no commitment expressed or implied to renew or extend their employment beyond the term of their contracts.

6. Definitions

Contact Hours

Teaching hours scheduled with students in a classroom, lab or clinical setting.  The required contact hours by discipline/program are specified in the Workload Appendix to the Full-time Faculty Collective Bargaining Agreement.  A copy of this agreement is available through a Human Resources Representative.

Exempt

A reference to the FLSA's exemptions for executive, professional, and administrative employees. Exempt employees are paid a salary and are not eligible for overtime pay.

Non-Exempt

An employee's status under the Fair Labor Standards Act, the principal federal wage-hour law.  Non-exempt employees receive a rate of pay at least equal to the federal minimum wage.  Non-exempt employees also are entitled to overtime time pay of at least one-and-one-half times their regular rate for hours worked in excess of 40 in a workweek.
