Article 13: Academic Freedom

13.1
The parties recognize that each employee, subject to parameters established by state and federal law and College approved curriculum, shall have the prerogative, right and responsibility to:
13.1.1
provide an unbiased, evidence-based presentation appropriate to the students assigned to the employee of all topics determined by the employee to be related to the College approved curriculum course content,
13.1.2
assess the performance of students and,
13.1.3
prepare curriculum and course content and choose textbooks for use by the employee's students.
13.2
Final student grades shall not be changed without consultation with the Instructor of Record for the course.
13.3
Faculty may be asked to remove or at least reconsider apparel or signage in the classroom or in the common passageways that is not related to instruction which is threatening, obscene, or disruptive. The employee shall be given the opportunity to explain to the Dean how such apparel or signage is, in fact, related to instruction. If the employee and the Dean cannot agree on the use of said apparel and/or signage, the issue will be decided by CNM's General Counsel.
