34.1
The parties recognize that within the parameters established by state and federal law and College and the approved curriculum, faculty members shall have the right and responsibility to:
34.1.1
provide an unbiased, evidence-based presentation of topics relevant to the course content and appropriate to the students assigned to the instructor,
34.1.2
assess the performance of students and,
34.1.3
prepare curriculum and course content and choose textbooks for use by the employee’s students
34.2
Final student grades shall not be changed without consultation with the Instructor of Record for the course.
34.3
Faculty may be asked to remove or at least reconsider apparel or signage in the classroom or in the common passageways that is not related to instruction which is threatening, obscene, or disruptive. The employee shall be given the opportunity to explain to the Dean how such apparel or signage is in fact, related to instruction. If the employee and the Dean cannot agree on the use of said apparel or signage, the issue will be decided by CNM’s General Counsel.
