Article 20: Privatization

Collective Bargaining Agreement for Full-Time Faculty

20.1

The College has the right and responsibility to determine what work is to be performed and by whom it shall be performed.

20.2

If cost savings is the reason the College considers contracting out any program offerings normally performed by employees, the College shall provide the Union written notice of the anticipated action no less than forty-five (45) calendar days prior to the planned implementation of the action. The term "program offerings" as used above shall not be interpreted to include the use of part-time employees.

20.3

Prior to making a final determination on the issue, the College shall allow the Union to present alternatives to contracting out employee services. In the event the College and the Union agree on cost-saving measures that may alleviate the need to contract out the services, the measures shall be implemented.

20.4

If the College allows bidding on the provision of employee services, the employees shall be allowed to bid to the extent provided by law.
