Article 26: Management Rights

Collective Bargaining Agreement for Full-Time Faculty

26.1

Unless limited by specific provisions of this Agreement, the College reserves the right to:

26.1.1

Determine the mission of the College and its division(s) and departments.

26.1.2

Set standards.

26.1.3

Exercise control and discretion over the College's organization and its operations.

26.1.4

Direct employees of the College.

26.1.5

Hire, promote, assign, transfer, and retain employees in positions within the College and suspend, demote, discharge or take disciplinary action against employees of the College.

26.1.6

Maintain the efficiency of the operations entrusted to the administration of the College.  This includes, but is not limited to, establishment and management of properties, resources and facilities; determination of the administrative organization; determination of the financial policies of the College; the appointment, direction, evaluation, discipline, and supervision of employees; the right to determine educational programs, the modality of course offerings, curriculum and services of the College; and the number and location of job positions required.  These rights are abridged only by the express specific terms of this Agreement. The College retains the right to specify the number of face-face courses and online courses a full-time faculty member will teach each term.

26.1.7

Relieve employees from duties because of lack of work or lack of funding.

26.1.8

Determine the methods, means and personnel by which such College operations are to be conducted.

26.1.9

Take actions as may be necessary to carry out the mission and functions of the College and maintain uninterrupted service to the students, instructors, and other employees in situations of emergency.

26.2

The employer shall retain all other rights not expressly abridged by this Agreement. These rights shall not be subjugated or diminished in any way by any expressed or implied duty to bargain unless it is specifically contained in this Agreement. This provision shall not be interpreted to prohibit bargaining on these issues in negotiations for a successor Agreement.
