Article 3: Definitions

Collective Bargaining Agreement for Full-Time Faculty

Unless otherwise specifically defined elsewhere in the agreement, the following definitions shall be applicable throughout the Agreement:

3.1

AGREEMENT -- This contract is between the Governing Board and the Union.

3.2

COLLEGE -- shall mean the Central New Mexico Community College or CNM.

3.3

UNION -- shall mean the CNM Employees Union.

3.4

EMPLOYEE -- shall mean a full-time faculty employee within the bargaining unit for which the UNION has been recognized as exclusive representative.

3.5

SUPERVISOR -- shall mean, when referring to a full-time faculty member’s supervisor, the Dean or the Dean’s Designee.

3.6

DEAN'S DESIGNEE -- shall mean the Associate Dean, Program Director, or any Academic Affairs Administrator.

3.7

DAYS -- shall mean Monday through Friday except for holidays which are observed by the College unless otherwise defined in this Agreement.

3.8

POLICY -- The Board's Collective Bargaining Policy (Governing Board Resolution 2020-53)

3.9

WORKSITE REPRESENTATIVE -- a Union member who is designated by the Union and approved by the CNMEU Executive Council to represent the Union in each school and at each campus.

3.10

PRESIDENT -- The chief executive officer of CNM.

3.11

CNMEU Executive Council – the body of currently elected union officers, currently appointed interim union officers, and currently held chairs of standing committees as per the CNMEU Constitution. 

3.12

Bargaining Unit – In accordance with the Public Employee Bargaining Act, the full-time faculty bargaining unit was established prior to July 1, 1999, and shall continue to be recognized as an appropriate bargaining unit for the purpose of the Public Employee Bargaining Act.

3.13

BOARD – New Mexico Public Employee Labor Relations Board (PELRB).

3.14

GOVERNING BOARD – shall mean the Central New Mexico Community College Governing Board.

3.15

Not In Good Standing – shall mean a condition in which performance and/or conduct concerns requiring remediation render a full-time faculty member, as determined by the Dean or the Dean’s designee, ineligible for leadership positions, optional professional development opportunities, or positions which would require the incumbent to represent the academic school or the College.

3.16

UNION REPRESENTATIVE – a member of the Union who is designated by the CNMEU Executive Council as qualified to represent the Union, any CNMEU Worksite Representative, any member of the CNMEU Grievances Committee, or any member of the CNMEU Executive Council.

3.16.1

Union member is defined as any dues-paying member of CNMEU in good standing as determined by the CNMEU Executive Council.

3.16.2

Worksite Representatives must be approved by the CNMEU Executive Council.

3.17   

MANAGEMENT – means a CNM employee who is engaged primarily in executive and management functions and is charged with the responsibility of developing, implementing administering, or effectuating management procedures or Governing Board policies. An employee shall not be deemed a management employee solely because the employee participates in cooperative decision-making programs on an occasional basis. Management employees are not part of the full-time faculty bargaining unit.
